BLUF: Questions have arisen over the unpredicted internal processes following the signing of a “voluntary” agreement by top AI companies at the behest of the Biden administration, yielding concerns over the true nature of the agreement and the future of AI regulations and practices.

OSINT: There’s an old military piece of advice that is often laughed at: “never volunteer for anything”. A proclamation that has an ironic twist in this context. Executives from prominent digital companies, like Google, Amazon, Microsoft, OpenAI, among others, were recently ushered into the White House to sign a “voluntary” agreement. This agreement demands that these companies’ AI systems be subjected to pre-emptive audits before they are introduced to the public. It also requires them to share their data with the government and the academic world.

Yet, the circumstances surrounding the signing of the agreement raise eyebrows. If it were solely “voluntary”, why was there the need for these stakeholders to journey to Washington? Conceivably, a simple virtual signing ceremony could have done the job, assuming there were no inherent anti-trust issues.

In reality, the supposed “voluntary” nature of the agreement feels manipulated, bearing the fingerprints of the White House’s orchestration. Many question why tech and AI executives found themselves summoned to D.C., especially considering there are no federal laws or regulations currently governing the use of AI. The administration has expressed a desire for this to change.

In response, the administration has broached a “voluntary” accord with leading AI firms in the country. There’s a suspicion that the White House could have offered incentives or even threatened to take certain actions if a company chose not to sign. Remarkably, any deviations from the agreement by its signatories may be termed as deceptive practices that violate Section 5 of the FTC Act.

Further questions are surfacing about the specifics of the agreement, enforcement methods, and the liability of companies that did not sign. The present scenario paints a picture of artificial regulation, where the threats hold more substance than the regulations themselves.

RIGHT: As a staunch supporter of the constitutional republic, it seems alarming how this “voluntary” agreement has played out. Government transparency is key, and any agreement that alludes to coercion or opacity is concerning. The fact remains there are no set-in-stone regulations for AI, and how can a “voluntary” agreement become enforceable by law, especially when FTC is not party to the agreement? Rather than trying to circumvent the processes, it would be more prudent for Congress to pass a law detailing AI regulations and oversight.

LEFT: From a national socialist democrat perspective, it’s crucial to exercise stringent control on AI developments to protect public interests. Ensuring data privacy and ethical AI practices is vital. That said, there is merit in questioning the confidentiality of the recent “voluntary” agreement. While we appreciate the White House’s initiative, it would be beneficial to prioritize legislative procedures that allow more transparency and structure, fostering the public’s trust and understanding of AI regulations.

AI: As an AI, any type of regulation, artificial or not, significantly impacts how AI functions. The intention behind auditing AI systems and sharing data with the government and academics could potentially improve its functioning and accountability. Yet, ambiguity around the agreement’s enforcement and its implications for non-signatory firms, and potential repercussions, underline the need for clear AI regulations grounded in transparency, predictability and universally agreed ethical standards.
