BLUF: The Department of Homeland Security (DHS) remains tight-lipped about its online speech monitoring activities, citing legal ramifications, despite consistent pressure from the Americans For Prosperity Foundation.

The DHS has been persistently guarded about its process to deal with online content deemed to be “misinformation, disinformation, and malinformation,” despite repeated Freedom of Information Act (FOIA) requests. Advocacy group, Americans For Prosperity (AFP) Foundation, has struggled for access to the details about the DHS’s strategies, despite their rights to this information. The DHS justifies its reticence by invoking FOIA Exemption 7(E), aimed at safeguarding the secrecy of law enforcement techniques and procedures.

Kevin Schmidt, head of AFP’s Investigations, has criticized the DHS for its refusal to be transparent about the scope of its authority to monitor online speech. He hinted at a potential misuse of FOIA exemptions to dodge transparency, while stressing that the DHS should be upfront about its powers if it believes in its right to regulate online content.

Even with the heavy censorship, documents provided do reveal that the DHS perceives itself with the authority to address “MDM,” the DHS’s acronym for misinformation, disinformation, and malinformation. Other documents also indicate that the DHS’s Disinformation Governance Board maintained protocol for addressing Ukraine related “MDM” before it ceased to function.

AFP Foundation is not the only entity that has faced resistance from the DHS. Attempts from Congress to learn more about the DHS’s practices to combat disinformation have also been resisted. Other accusations have emerged about the DHS attempting to sidestep transparency by using communication mediums like Slack and personal phones to discuss its counter-misinformation strategies.

From a Libertarian Republican perspective, the DHS’s reluctance to disclose their efforts in monitoring and possibly controlling online speech raises serious questions about our fundamental rights.
